KV Faces Class Action Over Recalled Generic Toprol

Law360 (April 16, 2009, 12:00 AM EDT) -- KV Pharmaceutical Co. and two of its subsidiaries have been hit with a proposed class action over their manufacturing practices for a hypertension medication that was among several KV drugs recalled in recent months.

Plaintiff Allen Lafaivre filed the suit Wednesday in the U.S. District Court for the Eastern District of Missouri on behalf of himself and others who purchased KV's metoprolol succinate extended-release tablets.

In late January, KV recalled the tablets, which are a generic version of AstraZeneca Pharmaceuticals LP's hypertension drug Toprol XL. The recall was among several St. Louis-based KV has issued in recent months after regulators uncovered...
