Judge Won't Reconsider Duty-To-Defend Bid V. Attys

Law360 (April 17, 2009, 12:00 AM EDT) -- A federal judge has declined to reconsider her refusal to grant summary judgment to an insurer seeking to get out of defending a law firm accused of taking kickbacks in silicosis liability settlements.

American Guarantee & Liability Insurance Co. failed to demonstrate extraordinary circumstances that justify the relief sought in its motion for reconsideration, District Judge Nancy F. Atlas ruled on Wednesday, upholding her denial of summary judgment in the insurer's lawsuit against Hoeffner & Bilek LLP.
