Overtime Class Action V. Wachovia Nixed

Law360, New York (April 17, 2009, 12:00 AM EDT) -- A presumptive class action alleging that Wachovia Corp. failed to pay employees overtime will not proceed after a California state appeals court upheld summary judgment against one representative plaintiff and rejected the other plaintiff's appeal of a lower court's denial of class certification.

In an opinion filed Thursday in the Court of Appeal of the State of California, Second Appellate District, Judge H. Walter Croskey wrote that both plaintiffs had barred themselves from their claims by signing releases or entering into settlements with Wachovia.
