N.C. Governor Violated Constitution: Judge

Law360, New York (September 7, 2006, 12:00 AM EDT) -- A Superior Court judge ruled Wednesday that North Carolina Gov. Mike Easley violated the state constitution when he diverted $225 million in state pension funds to help reduce a budget deficit.

In his summary judgment order, Judge Joseph R. John Sr. cited an amendment to the North Carolina constitution that reads: “Neither the General Assembly, nor any public officer, employee or agency shall use or authorize to be used any part of the funds of the Teachers’ and State Employees’ Retirement System…for any purpose other than...
