NJ Court Issues Mixed Ruling On Layoff Rule

Law360, New York (April 20, 2009, 12:00 AM EDT) -- A New Jersey appeals court has upheld most of an emergency rule permitting temporary layoffs in the civil service, but stayed enforcement of a clause that would allow managers to stagger those layoffs.

The Superior Court of New Jersey, Appellate Division temporarily stayed execution of part of an emergency rule on temporary layoffs, saying it was unclear whether those provisions adequately considered workers' regulatory and statutory rights.
