Court Hikes Royalty Fees For Toyota Hybrids

Law360 (April 20, 2009, 12:00 AM EDT) -- A federal district judge has upped the royalty rate Toyota Motor Corp. must pay Paice LLC for sales of the Prius, Highlander SUV and RX400h over the remaining life of a patent for hybrid cars held by Paice.

District Judge David Folsom of the U.S. District Court for the Eastern District of Texas on Friday raised the royalty rate from $25 per infringing vehicle to about $98.

Paice filed its suit in 2004, alleging that the three vehicles infringed U.S. Patent Number 5,343,970. A jury awarded...
