Prudential Insurer Loses Cert Bid In Asbestos Case

Law360, New York (April 20, 2009, 12:00 AM EDT) -- The U.S. Supreme Court has paved the way for thousands of former seamen at bankrupt shipping company Prudential Lines Inc. to receive payments for asbestos-related injury claims, rejecting an appeal Monday from the shipper's insurer, which took issue with the trustee's proposed payment structure.

Without comment, the high court refused to grant a writ of certiorari to American Steamship Owners Mutual Protection and Indemnity Association Inc., which had appealed a 2008 decision from the U.S. Court of Appeals for the Second Circuit.
