$5M Reef Repair Deal Voided By Hurricanes: 11th Circ.

Law360, New York (April 22, 2009, 12:00 AM EDT) -- A $5.2 million contract that a marine environmental services company entered into to repair reef damage near Fort Lauderdale, Fla., became void after hurricanes passed over the area, a federal appeals court has ruled.

But Monday's ruling, in the U.S. Court of Appeals for the Eleventh Circuit, instructed a federal judge to determine damages for work completed under the contract prior to the hurricanes by calculating the percentage of the contract work completed by plaintiff Hudson Marine Management Services Inc.
