Rx.com's Group Boycott Suit Time-Barred: 5th Circ.

Law360, New York (April 22, 2009, 12:00 AM EDT) -- Internet pharmacy Rx.com's case accusing pharmacy benefit managers Caremark RX Inc., Medco Health Solutions Inc. and Express Scripts Inc. of violating the Sherman Act by instituting a group boycott was correctly dismissed by a trial court in Texas because the plaintiffs' claims were barred by the applicable statute of limitations, a federal appeals court held.
