2nd Circ. Gives DOE Go-Ahead To Tighten Boiler Rule

Law360, New York (April 23, 2009, 12:00 AM EDT) -- A federal appeals court has granted a request by the U.S. Department of Energy to allow the agency to reconsider a rule requiring residential home furnaces and boilers to meet an 80 percent efficiency standard, which the regulation's opponents argue isn't strict enough.

The DOE asked the U.S. Court of Appeals for the Second Circuit on April 16 to remand two cases brought over the rule so that the department could reconsider the regulation. The agency told the court that it could complete the final rule,...
