NMFS Escapes From Suit Seeking To Protect Seals

Law360, New York (April 30, 2009, 12:00 AM EDT) -- A federal judge has determined that his court lacks subject matter jurisdiction to proceed with La Jolla Friends of the Seals’ suit against the National Marine Fisheries Service.

Judge William Q. Hayes of the U.S. District Court for the Southern District of California on Tuesday cleared the NMFS from the suit that accused them of taking the position that the federal Marine Mammals Protection Act authorizes San Diego to remove seals from a local beach without a permit.
