Gilstrap Says Remote Workers Don't Anchor Uniloc IP Suit

Law360, New York (December 8, 2017, 8:13 PM EST) -- Eastern District of Texas Judge Rodney Gilstrap has dismissed a patent suit that prolific plaintiff Uniloc USA Inc. brought against cloud computing company Nutanix Inc., ruling that 19 Nutanix employees who work remotely in the district do not give the company a place of business there.

The judge ruled Wednesday that the Eastern District of Texas is not a proper venue for the case over software maintenance patents, because San Jose, California-based Nutanix does not have a “regular and established place of business” in the district as required by the U.S. Supreme Court’s TC Heartland ruling.
