Corps Must Do Full Review Before Dredging: 9th Circ.

Law360, New York (April 30, 2009, 12:00 AM EDT) -- A federal appeals court has ruled that the U.S. Army Corps of Engineers is required to do a full review, including an environmental impact statement, before issuing a permit to dredge and fill navigable waters, reversing a lower court's decision related to an Arizona development project.

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit on Wednesday ordered the lower court to slap an injunction on a proposed master-planned community in Arizona until the full review is completed.
