Attorneys Lose Bid To Sanction Opposing Counsel

Law360, New York (May 1, 2009, 12:00 AM EDT) -- Green Jacobson & Butsch PC has lost its bid for sanctions against opposing counsel in a suit accusing the firm and three of its lawyers of breach of fiduciary duty related to a class action settlement.

Judge Carol Jackson of the U.S. District Court for the Eastern District of Missouri ruled Wednesday that the filing of the breach of fiduciary duty suit did not warrant the approximately $100,000 in sanctions the defendants had sought.
