PTAB Invalidates Hologic Patent, Rejects Claim Fixes

Law360, New York (December 15, 2017, 5:59 PM EST) -- The Patent Trial and Appeal Board on Friday found a Hologic Inc. medical device patent was invalid and rejected a series of proposed substitute claims, following a recent Federal Circuit ruling many believed gave patent owners a better chance at amending patents in America Invents Act reviews.

The board in a final decision said medical device startup Minerva Surgical Inc. showed each of the patent’s claims would have been obvious. Minerva had launched the PTAB challenge in 2016, after being accused of infringement by health care...
