Court Battle Fires Up In W.Va. Coal Waste Actions

Law360, New York (May 1, 2009, 12:00 AM EDT) -- Pretrial proceedings began Monday for more than 700 plaintiffs from several West Virginia communities alleging that Massey Energy Co. subsidiary Rawl Sales & Processing Co. destroyed their groundwater supply by injecting more than 1 billion gallons of coal slurry into abandoned mines.

Judge Michael S. Thornsbury worked last week to determine which plaintiffs wanted to proceed with their claims against Rawl and which were willing to accept a proposed settlement, preparing the case for class certification as it gears up for a trial expected to start...
