In Lakeridge, Concurring Justices Take The Spotlight

Law360 (March 12, 2018, 3:16 PM EDT) -- On March 5, 2018, the U.S. Supreme Court issued a unanimous opinion in the case of In re the Village at Lakeridge LLC holding that the appropriate standard of review for determining nonstatutory insider status is the clearly erroneous standard of review that was applied by the Ninth Circuit in Lakeridge, rather than the de novo standard of review that had previously been applied in similar circumstances by the Third, Seventh and Tenth Circuits.
