    A federal judge in Washington state on Monday denied the U.S. government's attempt to seek $3.5 million in attorneys' fees and costs from the Washington State Department of Transportation in a suit over tar pollution on the Tacoma waterfront, ruling it is too late in the litigation to ask for additional response costs.
