A West Virginia federal judge on Monday nixed the final claim in litigation against Bayer CropScience LP over a 2008 chemical plant explosion and its now-abandoned plans to restart methyl isocyanate production there, saying a wrongful death claim was time-barred.

West Virginia's Department of Environmental Protection moved Monday to quash subpoenas against its secretary and an employee, saying the plaintiffs in a suit against Bayer CropScience LP should be sanctioned for ignoring repeated warnings that they were targeting the wrong DEP members.
