A New York federal judge ruled Monday that luxury retailer Gucci America Inc. is entitled to receive more than $4.6 million dollars in damages over Guess Inc.'s infringing use of a particular G pattern and color scheme.

A New York federal judge on Tuesday clarified that although her recent ruling bars luxury retailer Gucci America Inc. from pursuing monetary damages for its claims that Guess Inc. diluted two of its trademarks, the company can still seek injunctive relief.

Guess Inc. lost a bid Tuesday to toss a trademark infringement suit brought by luxury retailer Gucci America Inc. after a New York federal judge found there is a genuine dispute as to whether shoppers are confused by similarities between Gucci and Guess goods.
