The Fourth Circuit on Monday refused to revive a whistleblower suit accusing Halliburton and its ex-subsidiary KBR Inc. of overcharging the government for water purification services, finding that, because the suit was filed while two similar cases were pending, it couldn't clear the first-to-file rule's primary hurdle.
