Alpha Unit's Selenium Pollution Violated CWA, Judge Rules
A West Virginia federal judge on Thursday ruled that Alpha Natural Resources Inc. unit Marfork Coal Co. Inc. discharged excessive amounts of toxic coal mining byproduct selenium into waterways, saying water testing proved the company violated state mining laws and the Clean Water Act.
