A New York federal judge Tuesday tossed a $40 million suit by residents and environmental groups that alleged fuel shipper Global Cos. increased oil traffic at an Albany, New York, train-to-barge terminal without the proper environmental permits under the Clean Air Act.

Albany, New York, residents and several environmental groups are seeking damages that could top $40 million from a fuel shipping company that allegedly increased oil traffic at a local train-to-barge terminal fivefold without the proper permit, the groups said Wednesday.
