Medtronic Dodges Spine Device FCA Suit, For Now
A California federal judge on Monday tossed a False Claims Act suit alleging Medtronic was responsible for ineligible claims submitted to Medicare and Medicaid by marketing a back surgery device for use in a patient's neck, but suggested the complaint could be amended to better explain how the device isn't safe, appropriate and medically necessary.
