A Dallas-based merchant services company can't escape a proposed class action accusing it of violating the Telephone Consumer Protection Act with unsolicited phone calls, a Colorado federal magistrate judge has ruled, rejecting the company's argument that the plaintiff hasn't alleged it used an automatic telephone dialing machine as defined in the law.
