IN CHAMBERS COURT ORDER by Judge Percy Anderson: Before the Court is a Motion to Dismiss filed by defendant 1-800-Pack-Rat, LLC ("Pack Rat") (Docket No. 21 ). The hearing calendared for September 14, 2026, is vacated, and the matter taken off calendar. The Court therefore grants Pack Rat's Motion to Dismiss. Because of Plaintiff's repeated failures to oppose Pack Rat's Motions to Dismiss, and the merits of Pack Rat's statute of limitations defense as explained in Pack Rat's Motion, the Court concludes that further leave to amend would be futile. The Court therefore dismisses the 1st AC's negligence claim without leave to amend, and dismisses Pack Rat from this action with prejudice. Despite the dismissal of Pack Rat with prejudice, because Plaintiff's claims against Nationwide remain pending, the Court will not issue a Judgment at this time. See document for further information.
