NO. 66] by Judge Maame Ewusi-Mensah Frimpong Granting in Part 54 MOTION to Dismiss: For the foregoing reasons, the Court ORDERS as follows: 1. The Motion to Dismiss (Dkt. No. 54) is GRANTED IN PART; 2. The breach of contract claim is DISMISSED WITHOUT LEAVE TO AMEND; 3. The UCL Claim is DISMISSED WITH LEAVE TO AMEND; 4. The breach of the implied covenant of good faith and fair dealing claim is DISMISSED WITH LEAVE TO AMEND; 5. Baskerville is not granted leave to add any additional claims; and 6. Should Baskerville seek to amend the UCL claim and the breach of implied covenant claim, he must file his amended complaint within thirty (30) days of the date of this Order. Failure to timely comply with this Order shall result in dismissal of the action without further warning. (see document for further details) (bm)
