Order on Motion for Attorney Fees Order on Motion for Extension of Time to File Response/Reply
TEXT ORDER: Before the Court now is both another Motion for Sanctions, (ECF No. 93 ), and a Motion to Extend the time to reply to same, (ECF No. 94 ). The Court refers Counsel to pages 27 to 29 of the Court's September 20, 2024 Opinion, which dismissed the first set of motions for sanctions without prejudice. (See ECF No. 91 at 27-29.) Specifically, the Court warned that "Plaintiffs and Plaintiffs' Counsel [were] skirting dangerously close to violating Rule 11, authorizing the imposition of its panoply of sanctions." (Id. at 28.) However, because the "Court believes that the imposition of sanctions would only prolong this torturous litigation for the more than forty named Defendants, who have expended significant time and resources over some eighteen months, and who, along with the Court, have been forced to run down rabbit hole after rabbit hole[,]" (id. at 29), the Motion for Sanctions, (ECF No. 93 ), is DENIED. The Motion for an Extension, (ECF No. 94 ), is therefore DENIED as moot. So Ordered by Judge Robert Kirsch. (pdm)
