Order on Motion to Strike Order on Motion for Leave to File Document
District Judge Patti B. Saris: ORDER entered re 202 Motion to Strike Relator's Declarations by Zimmer Biomet Holdings, Inc.; 209 Motion for Leave to File Supplemental Declarations to Supplement the Record in Opposition to Motion for Summary Judgment by Todd Langer. Zimmer Biomet's motion to strike Wise's and King's declarations (Dkt. 202 ) is DENIED, and Relator's motion for leave to supplement the record (Dkt. 209 ) is ALLOWED. In so ruling, the Court does not address the parties' arguments about whether these declarations suffice to satisfy the requirement that Relator "produce competent evidence of an actual false claim made to the government" at the summary judgment stage. Pfizer, Inc., 847 F.3d at 58. The Court will resolve those arguments, if necessary, when adjudicating Zimmer Biomet's motion for summary judgment, which remains under advisement. (CGK)
