Defendants have requested leave to file a motion to dismiss past the filing deadline (ECF No. 26 ). Plaintiff's response opposes the extension of the deadline (ECF No. 27 ). Under FRCP 6(b)(1)(B), the Court may grant an extension for good cause when the party failed to act because of excusable neglect. The Court is not persuaded by Plaintiff's arguments and finds good cause due to excusable neglect on account of Defendants' inability to electronically file via CM/ECF and inability to receive assistance from local counsel on that matter. Thus, the Court GRANTS Defendants' motion.
