ORDER - The Court granted Defendants' motion to dismiss and gave Plaintiff, Lewis L. Bond, a month to seek leave to amend his complaint before entering final judgment against him. Dkt. 66 . Mr. Bond did so, filing a motion for leave to file an amended complaint alongside an amended complaint. Dkt. 69 . Defendants have responded, dkt. 70 , and Mr. Bond replied, dkt. 71 . Mr. Bond's amended complaint contains almost identical factual allegations as his first complaint. This claim fails because Mr. Bond has not adequately pled that eh is in a fiduciary relationship with Defendants or, even if he was, that Defendants breached. Therefore, Mr. Bond's motion for leave to amend his complaint, dkt. 69 is denied. Mr. Bond's motion for an extension of time to file an amended complaint, dkt. 68 , is denied as moot. His complaint is dismissed with prejudice. Final judgment will issue by separate entry. (See Order.) Copy mailed to Plaintiff. Signed by Judge James Patrick Hanlon on 5/10/2024.
