SCHEDULING ORDER 329 Letter Motion for Extension of Time Motions due by 8/17/2026. Status Report due by 7/23/2026: On July 8, 2026, Plaintiffs filed a letter requesting an extension of their deadline to move for class certification, from July 16, 2026 to September 4, 2026. (ECF No. 329) Defendants consent to the request. This is now Plaintiffs fourth request for an extension of the Rule 23 briefing schedule. In the Courts last Order granting Plaintiffs identical request, the Court noted that it was unlikely to grant further extensions. (ECF No. 324.)Plaintiffs state that the requested extension is necessary because they are still coordinating with defense counsel to schedule depositions of opt-in Plaintiffs. But at the April 29, 2026 Case Management Conference, Plaintiffs counsel represented on the record that I will make sure to work with [defense counsel] on a [deposition] schedule and have one completed by tomorrow. The fact that no concrete deposition schedule appears to exist more than two months later gives the Court pause.Nevertheless, the Court will grant one final extension of the briefing schedule for Plaintiffs motion for class certification. Plaintiffs motion for class certification shall be filed by August 17, 2026; Defendants opposition shall be filed by September 17, 2026; and Plaintiffsreply shall be filed by October 1, 2026. No further extensions of this schedule will be granted absent good cause.The parties shall finalize the deposition schedule by no later than 2 weeks from today and submit a letter to the Court by July 23, 2026 setting forth the deposition schedule..
