Stipulation and Order of Voluntary Dismissal ~Util - Add and Terminate Parties
STIPULATION OF DISMISSAL: IT IS HEREBY STIPULATED AND AGREED by and between Limitation Petitioner Hapag-Lloyd Aktiengesellschaft a/k/a Hapag-Lloyd AG ("Hapag"), Claimant Pelorus Ocean Line, Ltd., ("Pelorus"), and Claimant MGF Sourcing US, LLC (hereinafter, "MGF"), through their undersigned counsel, that all claims, counterclaims, and crossclaims asserted herein by MGF and represented by the law firm ofLiskow & Lewis as described in MGF's Amending and Superseding Claim at Docket Nos. 887, 888, and 890, against Hapag, Pelorus, and any other party are dismissed with prejudice, pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure, with each party to pay its own costs and attorneys' fees; IT IS FURTHER STIPULATED AND AGREED by Hapag, Pelorus, and MGF, through their undersigned counsel, that this stipulation of dismissal shall not affect separate claims asserted by MGF and/or Starr Marine Insurance ("Stan") as the cargo insurers of MGF and represented by the law firm Hill Rivkins LLP, as described in the Answer to the Limitation Complaint with Counterclaims filed on behalf of Starr and other claimants at Docket No. 102, and the Second Amended Third Party Complaint filed on behalf of Starr and other claimants at Docket No. 233, which are not a part of or otherwise affected by this stipulation of dismissal; IT IS FURTHER STIPULATED AND AGREED by Hapag, Pelorus, and MGF, through their undersigned counsel, that all claims, counterclaims, and crossclaims asserted herein by Pelorus against Hapag or any other party are dismissed with prejudice, pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure, with each party to pay costs and attorneys' fees. Claimant MGF Sourcing US, LLC ("MGF") has voluntarily dismissed its claims in limitation against Hapag-Lloyd Aktiengesellschaft ("Hapag") and Pelorus Ocean Line Ltd., ECF Nos. 887, 888, and 889. Counter Claimaint Pelorus Ocean Line, Ltd. has voluntarily dismissed its counterclaims against Hapag and any other party, ECF Nos. 154, 754.
