Discussion had about erroneous filings related to the cross-motions for summary judgment pending hearing scheduled for 7/30/2026 before the district judge. ECF Nos. 22, 23, 24, 25 & 26. Specifically, [ECF [23-1]] Declaration of Joel E. Rapport (Rapport Declaration) inadvertently includes confidential information which the parties agree should be stricken and replaced by a corrected version. In addition, the parties agree that the portion of [ECF 24 & 25 ] Defendants cross-motion for summary judgment which references the offending confidential information contained in the [ECF [23-1]] Rapport Declaration should also be stricken and replaced by a corrected version.
Parties directed to submit appropriate stipulation by 7/20/2026.
On a separate issue, Defendant to file motion to seal selected summary judgment exhibits.
Court to advise the district judge.
