ORDER DENYING MOTIONS AS MOOT - On May 7, 2024, this Court granted the Plaintiff's Motion for Leave to File an Amended Complaint. (Docket No. 51 ). Plaintiff filed his amended complaint on May 8, 2024. (Docket No. 52 ). Because this new complaint supersedes the original and motions related to that original complaint, Defendant's Motion to Dismiss (Docket No. 34 ) and Defendant's Motion for Judgment on the Pleadings (Docket No. 39 ) are DENIED as moot. Fact Discovery is to be completed by 8/26/2024. Discovery Motions to be filed by 8/26/2024. Joint Alternate Dispute Resolution Report is due by 9/2/2024. Dispositive Motions are due by 9/30/2024. Expert and trial deadlines to be set at a later date. ORDER striking Pretrial Order deadline. The parties may file written consents to proceed before a Magistrate Judge at any time, but the court recommends that consent forms be filed before a dispositive motion (i.e., motion to dismiss, motion for summary judgment) is heard.
