TEXT ORDER: At the oral argument on 7/30/2026 at 1:00 p.m., the parties should be prepared to address the following questions: (1) If the Court finds that City of New York v. Chevron Corp., 993 F.3d 81 (2d Cir. 2021), is not distinguishable, is there any set of facts under which the Climate Change Superfund Act is constitutional? See Antonyuk v. James, 120 F.4th 941, 983 (2d Cir. 2024); and (2) If the Court finds that City of New York is not distinguishable, does the Court need to engage in any additional preemption analysis?
