For the reasons stated above, plaintiffs false CMI and misappropriation c laims are dismissed with leave to amend, together with all claims against Comcast, Versant, Verizon, and Apollo. Plaintiffs are also precluded from recovering statutory damages or attorneys fees absent revised allegations that overcome Section 412. P laintiffs claims for direct and secondary infringement of the Episode are dismissed with leave to amend, but their remaining claims against the other defendants survive. Within 14 days of the date of this Opinion and Order: (1) plaintiffs may amend t heir complaint as to the dismissed claims and defendants; and (2) the parties should submit by letter-motion a proposed case management plan that addresses the schedule for discovery and summary judgment in this case.
