Order on Motion for Discovery
ORDER denying 68 Motion for Discovery. Plaintiff's Renewed Motion To Re-Depose Defendant's Rule 30(b)(6) Representative (DE 68 ) DENIED. For more than two years, the parties have engaged in constant fights about discovery issues that have required court intervention and neither side is blameless. See generally New Falls Corp. v. Soni, No. 16-CV-6805 (HG) (LGD), 2022 WL 17811448, at *2 (E.D.N.Y. Dec. 19, 2022) ("Despite the straightforward nature of the singular claim raised in this action, this case has dragged on for nearly four years, generating extensive motion practice. While this motion practice is substantially attributable to the Defendant's and various non-parties' history of non-compliance with their discovery obligations, it also attributable to Plaintiff's repeated efforts to expand these discovery obligations beyond the scope of what is proportional to the needs of this case. In addition, counsel for both parties have consistently filed motions without following the proper practices and procedures of the Federal Rules of Civil Procedure and the Local Rules of this District -- resulting in still further submissions which have interfered with the efficient resolution of Plaintiff's claims. As discussed below, the motions currently pending before the Court are no exception.") (citation omitted). On 1/17/2024, the Court denied without prejudice Plaintiffs' motion to compel additional Rule 30(b)(6) depositions. See DE 66 . Plaintiff now seeks to renew this motion at DE 68 with the deadline to complete fact depositions (which has been extended numerous times) set for 5/10/2024 (see 2/29/2024 Order). This Court has "broad discretion to manage pre-trial discovery" and "the inherent authority to manage their dockets and courtrooms with a view toward the efficient and expedient resolution of cases." 12/15/2022 Order (citations omitted). It is long past time to bring fact discovery to a close in this case. See New Falls Corp., 2022 WL 17811448, at *6 (rejecting discovery request as the movant is "moving the goalposts regarding the remaining discovery to be conducted in this case... The Court shall not condone this endless fishing expedition") (citation omitted). Plaintiff has advanced no reasonable arguments for the Court to revisit its earlier ruling denying an additional Rule 30(b)(6) deposition. See, e.g., Analytical Surveys, Inc. v. Tonga Partners, L.P., 684 F.3d 36, 52 (2d Cir. 2012) (a motion for reconsideration "is not a vehicle for relitigating old issues or otherwise taking a second bite at the apple"). The Court therefore DENIES Plaintiff's Motion at DE 68 . Ordered by Magistrate Judge Lee G. Dunst on 5/2/2024. (CT)
