Order on Motion for Discovery
ORDER with respect to 163 Letter Motion for Discovery. In its response to Tatneft's motion to move beyond Phase 1 discovery, Ukraine proposes as a next step allowing Tatneft to seek materials from ten additional commercial banks of Tatneft's choosing and to limit such discovery to assets and accounts (1) located in the United States; (2) owned by Ukraine itself; that (3) are not used for military, diplomatic, or central banking purposes. By no later than Tuesday, September 8, 2026, Tatneft shall file a reply letter indicating whether it is willing to proceed with Ukraine's proposed compromise without prejudice to renewing its motion to move beyond Phase 1 discovery. If Tatneft is willing to proceed with Ukraine's proposed compromise, Tatneft shall identify in its reply letter the ten commercial banks of its choosing and propose a discovery schedule consistent with the approved Protective Order.
