STIPULATION AND ORDER OF DISMISSAL WITH PREJUDICE:IT IS HEREBY STIPULATED AND AGREED, by the attorneys for the Suretiesand Avalon, as follows: (1) all of the Sureties' claims, both as asserted in the action or which could have been asserted, against Avalon in-eluding, but not limited to, any claims arising from (a) the Agency Agreement between the Sureties and Avalon with an effective date of February 6, 2008, (b) the Letter of Authority entered into between the Sureties and Avalon dated January 11, 20 l 0 with respect to the Emerging Contractor Program, and (c) the bonds issued by Avalon under the Emerging Contractor Program, are dismissed with prejudice and without cost to any party; and as further set forth in this Order.
