(Text-Only) ORDER in Response to 91 Letter to Magistrate Judge.
The Court has reviewed the September 17, 2026 letter filed by Plaintiff Fairview Health Services ("Fairview") at Docket 91 relating to the September 4, 2026 Order 82 addressing several sealing motions. The letter requests that the First Amended Complaint 15 be placed under temporary seal pending a Motion for Further Consideration of Sealing anticipated to be filed by Defendant B. Braun Medical, Inc. ("B. Braun") 82 , which will be decided by the undersigned pursuant to Local Rule 5.6(f). Based on this anticipated motion, the Court orders the First Amended Complaint 15 TEMPORARILY SEALED. This Order has no bearing on the merits of the anticipated Motion for Further Consideration or any future sealing motion.
The letter also states: "B. Braun joins in the specific requested relief (i.e., that the Court allow a redacted version of the FAC to be filed pending future motion practice)." [91 at 1-2.] Given that a redacted version of the First Amended Complaint is at Docket 15, the Court DENIES that request as moot.
Moreover, the Court notes that the Second Amended Complaint 79 was publicly filed on August 20, 2026 (see [82 at 7]), but counsel asked clerk's office staff to restrict the Second Amended Complaint on September 10, 2026 and also filed a redacted version of the Second Amended Complaint 83 , both after issuance of the September 4, 2026 Order 82 noting the Second Amended Complaint was publicly filed. The parties must file a motion regarding continued sealing of the Second Amended Complaint on the same date as B. Braun files its Motion for Further Consideration given the anticipated overlap of issues presented by both pleadings. SO ORDERED.
