Order on Motion to Compel
PAPERLESS ORDER: On May 12, 2026, Defendant filed two 22 23 motions to compel discovery ("Motions"). Plaintiff did not timely respond. Based on representations in the parties' 29 Joint Discovery Plan, filed on June 2, 2026, I ordered the parties to file a joint status report stating whether any disputes as to the Motions remained, and, if so, whether the scope of the disputes had been narrowed. See DE 31. The parties filed the required 33 status report on June 10, 2026. This report states that though some disputes raised by the Motions have been resolved, Plaintiff served supplemental discovery responses that "created new issues," and Defendant is still in the process of reviewing Plaintiff's supplemental production. DE 33 at 1-2. Defendant requests oral argument on the Motions. Id. at 33. In light of the status report's representations that the scope of the disputes raised in the Motions has changed, including through the appearance of new issues that have not been briefed, Defendant's 22 23 Motions are DENIED WITHOUT PREJUDICE. Defendant may file new motions to compel that outline the issues as they stand based on Plaintiff's supplemental responses and production. Defendant may renew its request for a hearing in any newly filed motions. Further, Plaintiff is cautioned that failure to respond to any newly filed motions may result in the Court granting the motions by default. S.D. Fla. L.R. 7.1(c)(1).
