Plaintiffs and Barclays Bank Delaware disagreed on the number of fact depositions to which Plaintiffs would be entitled, with Plaintiffs seeking seven and Barclays three. The Court ruled in favor of Plaintiffs, given that it appears from the 26(f) report that Barclays made at least two internal decisions in this case. However, the Court expects Plaintiff not to take all seven depositions if they do not need all seven and the Court's doors are open if Barclays believes that a protective order is justified. The Court and the lawyers will hold a status conference on 11/16/2026 at 10:00 AM via Audio-only Conference (no courtroom). The agenda will be the status of discovery, the likelihood of a negotiated resolution versus trial, whether a settlement with the magistrate judge will be needed, and if so, what the optimal timing of such a settlement conference would be.
