ORDER SETTING SETTLEMENT CONFERENCE A settlement conference will be held before United States Magistrate Judge Ryan C. Carson with counsel and representatives of the parties on September 28, 2026, at 9:00 a.m. in Courtroom #7, Roman L. Hruska United States Courthouse, 111 South 18th Plaza, Omaha Nebraska. The parties representatives and/or counsel shall be prepared to participate and negotiate a settlement of this case during the conference. To avoid unnecessarily incurring travel and other expenses if the settlement conference is canceled or postponed, any request for cancellation or postponement must be made on or before September 7, 2026. Counsel shall submit a confidential settlement statement to carson@ned.uscourts.gov no later than September 21, 2026, setting forth the relevant positions of the parties concerning factual issues, issues of law, damages, and the settlement negotiation history of the case, including a recitation of any specific demands and offers that have been conveyed. Magistrate Judge Carson will hold a telephone conference with counsel on September 25, 2026, at 10:00 a.m.. for the purpose of reviewing any outstanding issues that may be relevant prior to the settlement conference. Order on Motion to Exclude Order on Motion to Dismiss Party
ORDER DISMISSING PARTY - IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that Defendant, United States of America, be dismissed. Defendant, Mary Oyeleye, DMD, remains a party in this matter. Furthermore, the Court denies the United States's Motion to Exclude, Filing No. 128 , as moot in light of the United States's dismissal as a party. However, the Court recognizes that Defendant Mary Oyeleye has joined the United States's motion to exclude at Filing No. 133 , and will consider the arguments made in the briefing related to Filing No. 128 when ruling on Defendant Mary Oyeleye's motion.
