On January 16, 2024, I allowed Defendant's second motion to compel, and awarded it attorneys fees and expenses as sanction against Plaintiff. See Doc. No. 38 . On January 26, 2024, Defendant filed its accounting of time and expenses related to the motion, Doc. No. 40 . Defendant seeks a total of $3,755.50 in attorney's fees. Defendant does not detail the experience and skill of each of the attorneys, but the requested rates of $255 for Attorney Jeanette M. Figueroa and $310 for Attorneys Matthew Freeman and Jamie L. Kessler fall comfortably within the range of reasonableness. Plaintiff has not filed a response. Nevertheless, I have conducted a review of the time records which shows that the attorneys spent a combined time of 11.1 hours drafting the motion and 2.2 hours preparing for the hearing, and 0.5 hours to attend court to argue the motion. The time spent drafting the motion and the time spent preparing for the motion is excessive in light of the issues involved and the motion that was filed. I reduce that time by one-quarter for a total compensable time as follows:
Attorney Figueroa 7.125 hrs $255 $1,816.87
Attorney Freeman 1.200 hrs $310 $372.00
Attorney Kessler 2.150 hrs $310 $666.50
TOTAL: $2,855.37
