MINUTES (IN CHAMBERS) ORDER GRANTING DEFENDANT BOSTON SCIENTIFIC CORPORATION'S MOTION TO DISMISS 26 by Judge Fred W. Slaughter. For the reasons stated above, the court GRANTS the Motion. Plaintiff's First Amended Complaint is DISMISSED WITH LEAVE TO AMEND. Federal Rule of Civil Procedure 15 provides that courts "should freely give leave when justice so requires." Fed. R. Civ. P. 15(a)(2). Here, the court exercises its discretion to allow Plaintiff an opportunity to address the issues presented in its First Amended Complaint. Any amended complaint, either amending or omitting the claims dismissed in this Order, shall be filed on or before October 22, 2026. Failure to file an amended complaint on or before the deadline set by the court will result in the dismissal of this action without prejudice without further notice for failure to prosecute and/or comply with a court order.
