PAPERLESS ORDER STRIKING the 32 33 Motions to Dismiss. Under our Multiple Defendants Order 9 , “[a]ll Defendants must jointly file any motions,” and “[t]he time for each Defendant to answer or respond by motion to the complaint begins to run once all Defendants have either been served or waived service.” Id. at 1-2. But our Defendant, ByHeart, unilaterally filed duplicative Motions to Dismiss. That’s not right.
Our Plaintiffs have yet to serve all the Defendants. See Paperless Order 28 (“The Plaintiffs may serve the Defendants Liza Elliott Ramirez and Expecting Models, Inc. through the Florida Secretary of State by July 10, 2026.”). Once all Defendants have been served, all Defendants must jointly file a single motion to dismiss.
