ORDER DISCHARGING ORDER TO SHOW CAUSE AND DISMISSING CIVIL ACTION by Judge Andre Birotte Jr. On August 2, 2021, the Court issued an Order to Show Cause why it should not dismiss this action for lack of prosecution. The Court is in receipt of Plaintiff's response 19 filed on August 16, 2021. The Court deems that response satisfactory, and orders the Order to Show Cause discharged. Furthermore, the Court having been advised by counsel that the above-entitled action has been settled; IT IS THEREFORE ORDERED that this action is hereby dismissed without costs and without prejudice to the right, upon good cause shown within 45 days, to re-open the action if settlement is not consummated.
