Order Dismissing Case
TEXT ORDER. On June 12, 2026, the Court directed Plaintiff to show cause by no later than June 26, 2026, for his failure to file an AO239, Application to Proceed in District Court without Prepaying Fees or Costs (Long Form), as the Court had directed in a prior Order. (Doc. 7). The Court warned Plaintiff that failure to show cause would result in a dismissal of this action. (Id.). Plaintiff failed to show cause as directed. Accordingly, this case is DISMISSED without prejudice for failure to prosecute in accordance with Local Rule 3.10. See, e.g. Link v. Wabash R.R. Co., 370 U.S. 626, 630-31 (1962) ("The authority of a court to dismiss sua sponte for lack of prosecution has generally been considered an 'inherent power,' governed not by rule or statute but by the control necessarily vested in courts to manage their own affairs so as to achieve the orderly and expeditious disposition of cases.").
