ORDER. On March 29, 2024, the Court noted that its review of the record showed Third-Party Defendant Mary Ann Kenny Smith had not entered an appearance in this matter. (Doc. 515, pg. 4). Therefore, within 30 days, Defendants/Third-Party Plaintiffs the Board of Directors of CQH, Robert Barrows, Jeffrey Watson, and the Administrative Committee of the Casino Queen ESOP were directed to show cause as to why Ms. Kenny Smith should not be dismissed for a failure to prosecute under Federal Rule of Civil Procedure 41. (Doc. 515, pg. 4). Now, the aforementioned Defendants/Third-Party Plaintiffs have filed a Response to the Order to Show Cause, indicating Ms. Kenny Smith died on December 17, 2021. (Doc. 523). They have been unable to determine whether an estate was opened for her or the identity of a successor, executor, or personal representative. (Doc. 523). As a result, Defendants/Third-Party Plaintiffs seek to voluntarily dismiss Ms. Kenny Smith in the same manner, and for the same reasons, articulated by the Court as to the other members of the Kenny Group on March 29, 2024. Accordingly, consistent with the Court's reasoning on pages 5 and 6 of the Memorandum & Order at Doc. 515, the Third-Party Complaint at Doc. 153 is AMENDED by interlineation. The claims against Third-Party Defendant Mary Ann Kenny Smith are STRICKEN. As agreed to by the parties, the dismissal of the claims is without prejudice. Signed by Judge David W. Dugan on 4/30/2024.
