MINUTE entry before the Honorable Edmond E. Chang: (1.) Pursuant to the stipulated dismissal, under Federal Rule of Civil Procedure 41(a)(1)(A)(ii), and to avoid unnecessary status hearings an d to provide time to exchange consideration, the case is dismissed without prejudice and with full leave to reinstate via motion filed by 01/11/2027. The Court sets a fixed date rather than the indefinite deadline proposed by the parties (21 days after the receipt of consideration). If the consideration is received earlier, then the parties may (and should) file the stipulated dismissal with prejudice before 01/11/2027. If it appears that the consideration will be received later, then the parties may file a motion to extend the reinstatement deadline. If no motion to reinstate is filed by that date, then the dismissal will automatically convert to a dismissal with prejudice, without further action by the Court. (2.) With the stipulated dismissal in place, and on review of the motion 121 for default judgment as to the organizational defendants, R. 121, the motion is granted. Judgment shall be entered in favor of the Plaintiff and against Defendants CDL 1000, Inc.; CDL 1000 LLC; and Batch Freight LLC, in the total amount of $368,066.55. Post-judgment interest shall accrue on $260,969.10 of that award. The award is comprised of FLSA and IMWL overtime damages (and multipliers under the statutes) of $88,520. The IWPCA award is $172,448.70. Reasonable attorney's fees and costs are awarded in the amount of $107,097.45. A separate AO-450 judgment shall be entered. Status hearing of 10/09/2026 is vacated.
